1. Acceptance of Terms

- It is prohibited for you to duplicate or alter the Plantful, any portion of the Plantful, or our trademarks in any manner. It is prohibited to try to extract the Plantful source code, translate Plantful into other languages, or create derivative versions of Plantful. Technoful Anonim Sirketi retains ownership of the Plantful as well as any trademarks, copyrights, and other intellectual property rights associated with it.

- For Technoful to provide our Service, we have to store and process the personal data submitted by you. You are in charge of protecting your phone and your access to the Plantful App. As a result, we advise against jailbreaking or rooting your phone, which involves taking out constraints and software restrictions imposed by the manufacturer's official operating system.

- It is not always within Technoful's control how you use the Plantful App. It is your duty to keep your device charged; Technoful cannot be held responsible if it runs out of energy and you are unable to switch it on in order to use the Technoful Service. Users are also in charge of making sure their internet connection is stable. Your device must have an active internet connection to use Plantful App's functions. You could either use your mobile network provider or Wi-Fi. However, if you don't have access to Wi-Fi and your data allowance is not left, our organization cannot be held accountable for the Plantful App's lack of operation.

- Technoful makes no guarantees that the Plantful App will always be updated to reflect your needs and/or function with the iOS or Android version that is now loaded on your device. You do, however, agree to accept updates to the application whenever they are made available to you. Likewise, we may decide to discontinue providing the Plantful and may stop maintaining it at any time without informing users. The rights and permissions granted to you under these terms may terminate at any time unless we notify you otherwise. Alternatively, you may stop using the Plantful App and you can remove it from your device if necessary.

- Please be advised that while using Plantful, the services we offer should be classified as professional plant health or healthcare services. Therefore, they should not be accepted as legal or professional advice. Any information, data, or communication sent as an output through Plantful is not the responsibility of Technoful.

- In addition to the terms of this agreement, you may have certain rights that cannot be waived by the laws of the jurisdiction in which you reside. Certain provisions of this agreement also may not apply to you. The remainder of the agreement shall remain in full force and effect, except to the extent that any term or condition of this agreement is unenforceable.

- Hereby, you affirm that: (a) you are of legal age to enter into this agreement; (b) you are at least eighteen (18) years old, (c) or under the legal majority age in your state and using the Apple App Store and/or Google Play only with your parent's or legal guardian's approval; and (d) you have read, understood, and agree to be bound by this agreement in its entirety. Users should be informed that to access Google Play, users should have an active Google account, subject to the age restrictions mentioned, and follow any additional age restrictions that might be applicable in order to access the features or content on Google Play.

- Notice For Parents and Legal Guardians: By allowing your child to download, install, use, access, register with, or make in-app purchases in the Technoful apps, you agree to the terms of this agreement on behalf of your child. You are responsible for supervising your child’s online and offline activities. If you do not agree to these terms and conditions, please do not let your child to use the Technoful apps. If you are the parent or legal guardian of a child under 18 and believe your child is using the Technoful apps without your consent, please contact us at [email protected]

2. Disclaimers

- Technoful does not guarantee that; the service will be up to your standards, it will operate without interruption, promptly, securely, or without errors. Also, it is not guaranteed that the information or results obtained from using the service will be accurate or dependable or the quality of any goods, services, information, or other materials you buy or reach through the service will match your expectations or provide you any benefits

- Hereby Technoful does not accept any responsibility for Plantful app recommendations regarding watering, filterizing, or any other plant care. Users should carefully read the recommendations provided by the manufacturers of the fertilizers.

- Each plant's health depends on various factors, such as climate, moisture, and amount of daylight. The use of this service should be based on your assessment. Hereby you should acknowledge that the company is not liable for the health of your plant, whether directly or indirectly related to the purchase and use of the service. It is recommended that users consult with gardening, botany, and other relevant professionals regarding the information available on or accessed via the Plantful App.

3. Service

- Users agree that the Company and/or third parties own all rights to all text, images, marks, logos, compilations, data, other content, software, and materials that are displayed on the Service or used by the Company to run the Service.

- All of the aforementioned rights, including those related to intellectual property, are reserved by the Company. Any usage, redistribution, sale, decompilation, reverse engineering, disassembly, translation, or other exploitation of them is forbidden unless allowed by these Terms. Users and third parties do not acquire any rights, title, or interest in or to such intellectual property rights as a result of the Service's offering.

- In connection with the Service, users provide the Company the non-exclusive, transferable, worldwide, permanent, irreversible right to publish, distribute, publicly show, and perform the User Content.

- According to these Terms, the Company provides you the following licenses: (a) install and use the App only on your mobile device like iPhone, Android, etc. as relevant and only for your personal, non-commercial purposes; and (b) use the Service exclusively for your personal, non-commercial purposes.

- Company reserves the right, with or without prior notice, to make any modifications to the Service, including to features that are paid for or available for free. Users understand that the Company may take different actions that restrict or stop them from using the Service at specific times. These actions could either be temporary or permanent. Users accept that the Company will bear no accountability or liability for any such actions or outcomes, including, without limitation, the removal of any content or services that the Company may not have made accessible to you.

- Technoful bears no duty to offer users any type of customer support. In the meantime, in its sole decision, Technoful may occasionally offer you customer support.

4. Third-Party Partners

- App Availability and Third-Party Compliance: You agree that third-party stores, such as the Google Play Store, Apple App Store, and other app distribution channels are what make our app available. Users also accept responsibility for any costs incurred by these App Stores in connection with the App. Additionally, you consent to abide by any relevant terms of service, agreements, and App Store regulations. Following these guidelines grants you the permission to use the App. You understand that these terms are third-party beneficiaries and that the App Stores may enforce these terms against you.

- Release of Liability By using our service, you hereby release us, our officers, employees, agents, and successors from any claims, demands, losses, damages, rights, and actions, including property damage, death, and personal injury, resulting directly or indirectly from your interactions with any App Store, other Service users, or third-party advertisers.

- Third-Party Ads and Links: Links to information and ads from other parties ("Third-Party Ads") may appear on our service. We have no control over these Third-Party Ads, and we disclaim all liability regarding their accuracy or content: These links are provided for your convenience; we do not approve, check, supervise, or guarantee any Third-Party Ads. You are solely responsible for your interactions with these third-party websites, and before making any purchases, users need to review their terms, policies, and privacy policies. Any type of transactions, including the purchase and delivery of goods or services, that take place between you and the third-party advertisements that you see on or via our service are entirely between you and the advertiser.

- Third-Party Services and Content Integration: Plantful app could work with or be offered alongside content, feeds, ads, or services from third parties. By utilizing our app, which contains certain third-party components, you agree that the terms of service and privacy policies of the relevant third parties apply to such services and content. These other websites and resources are not within our control, and we disclaim all liability for any losses or damages that arise from your use of or reliance on any products, services, or other content that is made available via these third-party resources. Technoful is not accountable for any issues that may arise from contacts between users and third-party service providers, nor do we audit such transactions.

5. Indemnification

- By using the Technoful Services, providing information about yourself, or violating any other part of this agreement, you agree to indemnify and hold harmless Technoful, its affiliates, and each of their officers, directors, employees, contractors, agents, partners, shareholders, and third-party service providers ("Indemnitees") against any claims, liabilities, costs, and expenses, including reasonable attorney's fees.

- Users acknowledge that an indemnitee may choose to hire legal counsel. It is solely your responsibility to fight any claim brought against an indemnitee and also your responsibility to pay for any potential losses or damages. Plantful App users should not accept any agreement that results in any responsibility or liability on any indemnitee without receiving Technoful's explicit approval.

6. Term And Termination

- Technoful reserves the right to unilaterally terminate this Agreement without compensation or further notice if the User breaches this Agreement or any applicable agreements or rules for services offered on the Apple App Store and/or Google Play. This includes, but is not limited to, situations where the User manipulates the operation of Technoful Apps by any method, violates the provisions of this Agreement or other agreements on the Apple App Store and/or Google Play, infringes on third-party rights, or shares data, content, visuals, texts, or articles with Plantful that are unlawful or intended for unlawful or immoral purposes, even if they are not inherently unlawful or immoral.

7. Limitation Of Liability

- To the extent permitted by applicable laws, you acknowledge and agree that Technoful and its affiliates shall not be liable for any direct, indirect, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, use, data, or other intangible losses, resulting from: (i) your use or inability to use the Service; (ii) unauthorized access to or alteration of your transmissions or data; (iii) statements or conduct of any third party on the Service; or (iv) any other matter relating to Technoful.

- Access to and use of the Service (including the App, website, content, and User Content) and third-party advertisements are at your own discretion and risk. You will be solely responsible for any damage to your computing system or loss of data that results from such activities.

- Notwithstanding anything to the contrary contained herein, you accept that the aggregate liability of Technoful to you for any claims arising from the use of the Service is limited to the amounts you have paid to Technoful for access to and use of the Service. These limitations of damages are fundamental elements of the basis of the agreement between Technoful and you.

- Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. Therefore the above limitation or exclusion may not apply to you. You may also have other legal rights that vary from jurisdiction to jurisdiction. As Technoful operates in Turkey, nothing in this agreement shall be construed to create any employee/employer relationship under the Labor Code numbered 4857 of Turkey or applicable legislation.

8. Subscription & Payments

- Plantful app is free to download but a membership or subscription may be needed to access some features. When the applicable fees and taxes occur, you are in charge of paying them to the App Store.

- Technoful retains the right, to the extent permitted by law, to change subscription costs. You give the App Stores permission to charge the corresponding fees to the payment method you have supplied when you subscribe. There is a function that allows subscriptions to automatically renew. By registering Plantful App, you agree that your membership will automatically renew unless you follow the instructions to cancel. Subscriptions that are canceled are not eligible for refunds or prorated costs.

- Users are in charge of following the trial period even if Technoful could send reminders. We retain the right to restrict the number of free trials available to any user and to change or cancel free trial offers at any time. This could be executed without prior notification.

- The App Store's return rules apply to subscriptions that are purchased through it. We are unable to issue refunds directly; for assistance, please get in touch with the App Store's support team.

- Technoful does not conclude any of the in-app purchases; rather, it is the Google Play or Apple App Store that charges you for them. The terms and conditions of Google Play and/or the Apple App Store apply to these purchases. Any queries about billing and refunds should be sent to these platforms directly. That being mentioned, Technoful is unable to access user accounts and transaction history via these app stores. Our Applications are available for download on a worldwide scale via Google Play and/or the Apple App Store.

9. International Use

- It is forbidden to access or use the Service from areas where it would be illegal. Technoful makes no representations regarding the accessibility, appropriateness, or legal availability of Plantful App for use in your local jurisdiction. Users are in charge of complying with local regulations and you are using Plantful App on your initiative.

10. Intellectual Property Rights

- Intellectual Property Rights: Technoful owns all rights, title, and interest in and to the products and services, including any related projects, documents, designs, software, and intellectual property (collectively, "Technoful Content"). This includes but is not limited to, all visual elements, texts, bulletins, slogans, videos, designs, databases, system data, logos, trademarks, trade dress, source code, and proprietary methods. Technoful is the exclusive owner of all rights granted under the Law on Intellectual and Artistic Works No. 5846 of Turkey. IP rights granted by any relevant international intellectual property laws also have the same effect. Reverse engineering, decompiling, or attempting to access the source code of Technoful apps or services are prohibited. Such violations may result in liability for any losses sustained by Technoful or third parties.

- User-Generated Content: Users are responsible for any of the content they contribute, submit, or display via Technoful’s services to comply with any laws. Users are also responsible that their content does not infringe on the intellectual property rights. Users hereby agree to compensate Technoful and third parties for any damages resulting from unauthorized use of content. We do respect the rights of copyright holders and will act to remove content that infringes on these rights. Users who repeatedly infringe on intellectual property rights may lose their access to Technoful services.

- Inappropriate Content: Technoful retains the right, at its sole discretion, to delete any content that it assumes is inappropriate. Contents that are harmful, illegal, abusive, insulting, or otherwise improper are included in this. Users agree to refrain from violating any laws, or spreading misleading information when using Technoful services. Technoful may monitor contributions and remove material as needed, but we do not assess the uploaded content beforehand. Some examples of objectionable content are the ones that may harm minors; personal data like phone numbers, addresses, national ID numbers, social security numbers, or any other information that harms another person's privacy; vulgar, racist, profane, or pornographic material; unsolicited or unauthorized advertising, marketing materials, junk mail, spam messages, chain letters, pyramid schemes, or any other form of solicitation; and material containing software viruses, malicious software, or any other offensive content.

- Google Play & Content Usage: Users aren't allowed to utilize Technoful services in combination with stream-ripping or similar applications to record material. Users are not permitted to remove watermarks, labels, or proprietary information, or to change material to hide ownership. Repeated breaches may result in loss of access to Technoful services. Technoful does not and cannot monitor all content submissions; however, it has the right to modify, deny, or remove content at its own initiative. Users have no expectation of privacy when they submit content. Technoful has the right to cancel a user's access to its services if the user is determined to be a repeat infringement under relevant regulations.

- If you genuinely think that content generated or transmitted using Plantful violates your copyright, privacy, or personal rights, you can reach out [email protected] and ask us to take down the content or prevent access to it.

11. Additional Rights And Limitations

- Users agree not to use Technoful Apps in any way that could compromise the usage of Technoful Services, break the law, violate ethical codes, or involve any of the following examples. Technoful retains the right to terminate this Agreement and to permanently or temporarily bar the user from using the Technoful Apps. Technoful disclaims all duty and responsibility for any damages resulting from any violation of this article. Furthermore, Technoful retains the right to seek legal action in both civil and criminal courts.

- The user is prohibited from duplicating, adjusting, converting, decompiling, or reverse-engineering the Service, or employing it for any purpose of the kind or in any illegal manner. This involves, among other things, not using Technoful Apps in any way to create derivative works or make modifications to the Service. The software innovations and enhancements made by the User in the Software will remain the property of Technoful. Additionally, the activities of the User include, among other things, detecting secret codes to hack, trying to associate Technoful Apps with other third-party software/hardware, disrupting the security of a machine, hacking passwords and codes of a machine, using the system to deliver spam, or introducing malware, are strictly forbidden. The User further agrees to release Technoful from and hold Technoful harmless for any monetary damages and will assume financial responsibility for the damages incurred by other parties concerning the violation of the Agreement.

- Technoful has the right to limit or end access to Technoful Apps anytime and without notice when the operational security of the network is endangered. This right is used to ensure continuity of access to the network, preventing system failure and file uploads, mitigating possible service interruptions or reducing their impact. Termination rights may be used as well as for other reasons that are assessed necessary.

- Technoful’s Apps may not be availed through a platform where multiple individuals may download it without prior written consent from Technoful. Users are prohibited from renting, selling, transferring, leasing, distributing, sublicensing, or assigning the Technoful Apps or any right about the Technoful Apps or any of our Apps for this matter which would entail transmitting data through third parties. It is agreed by users that they will not use robots, spiders or other automated ways which can interfere with the Software’s regular functioning; except when uninstalling within user’s possession mobile devices. Users should avoid posting illegal stuff on our platforms such as injurious writings or making destructive chain letters and viruses. The Software shall not be misused by users nor will they attempt to interfere with them in any way nor shall you bypass, disable, or otherwise interfere with any security features of Technoful Apps. Users must refrain from repeating such acts in an automated manner.

- Payments for Technoful App purchases may be processed either by third parties acting on behalf of Technoful or directly by the mobile platform owner. In some countries like those within the European Union, certain laws give consumers the right to cancel online purchases within a certain time after the transaction. The right to cancel in-app purchases will depend on the country of residence.

- Since payment processing for certain purchases on Technoful Apps is handled by the mobile platform owner, compliance with local laws regarding the right to cancel will be subject to the terms set by the mobile platform owner. Please review the mobile platform owner’s terms regarding cancellations before making a purchase. Additional information on canceling orders and obtaining refunds can be found on the website of the third-party reseller from whom the app was purchased like the Apple App Store or Google Play.

- For further functionality, you might need to establish an account with some Technoful Apps. This will appear when you attempt to use those functions, if necessary. It is your responsibility to keep your IDs and passwords safe. You are accountable for all transactions performed using your account. In case of any unauthorized usage or security breaches, you should inform the Technoful team immediately. Technoful team has the right to suspend or delete your account if it is believed to be compromised. Users have the sole responsibility to provide accurate information during the registration. False information could result in termination or suspension. You can register via email, Google, Apple, or other third-party means. Damages resulting from account security neglect or abuse are not Technoful's responsibility. Certain features of the Technoful Apps may be accessible only to registered users, and without registration, you may not be able to access all functionalities.

12. Term And Termination

- Technoful reserves the right to immediately terminate this Agreement without compensation or further notice. This immediate action is taken if the User breaches this Agreement or any applicable agreements or rules for services offered on the Apple App Store and/or Google Play. This includes, but is not limited to, situations where the User manipulates the operation of Technoful Apps by any method, violates the provisions of this Agreement or other agreements on the Apple App Store and/or Google Play, infringes on third-party rights, or shares data, content, visuals, texts, or articles with Plantful that are unlawful or intended for unlawful or immoral purposes, even if they are not inherently unlawful or immoral.

13. Disclaimer of Warranties

- You acknowledge that your use of the App and its services is entirely at your own risk. The services, along with all materials, information, software, and content available within the App, are provided on an "as is" and "as available" basis. We make no express or implied warranties regarding the merchantability, technical excellence, or availability for a particular purpose of any service, product, or material provided under this Agreement. We do not guarantee that the functions offered through the services will be uninterrupted or error-free, that any defects will be corrected, or that the services or servers hosting the services are free of viruses or other harmful components.

- Since we allow user content to be publicly displayed in the Plantful App, we are not responsible for any images uploaded by other users that users may view. Technoful development team monitors the quality of content using both manual review and automated tools. Plantful App uses automatic filtering technologies developed to detect and block content that is legally prohibited, immoral, etc.

14. Force Majeure and Applicable Law

- Any failure by the Company to act in accordance with this Agreement, or any delay or partial performance, resulting from events that fall within the legal definition of a "force majeure event" will not subject Technoful to liability. Such circumstances will not be considered a breach or default, and no compensation claims can be made against Technoful.

- Any circumstance that is outside the affected party's reasonable control and that Technoful makes every attempt to avoid is referred to as a "force majeure event." Events that fall under this category include, but are not restricted to, natural disasters; riots; rebellions; turmoil; war; breakdowns in communication; infrastructure and internet network failures; power outages; strikes; fires; terrorism; cyberattacks; internet outages; computer viruses; and unfavorable weather.

- Turkish law shall control and be applied to the interpretation of this Agreement and any legal relationships resulting from it. Any disputes arising out of this Agreement will be heard by the Turkish courts. You consent to the jurisdiction and venue of these courts, to the extent allowed by law. Hereby you waive any objections to such jurisdiction and venue.
