These Terms and Conditions (“Terms”) govern your access to and use of the mobile and web applications provided by Technoful Teknoloji Limited Şirketi (“Technoful,” “we,” “us,” or “our”). The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Technoful, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This license does not include:

● Any resale or commercial use of the Services or their contents

● Any collection and use of any product listings, descriptions, or prices

● Any derivative use of the Services or their contents

● Any downloading or copying of account information for the benefit of another merchant

● Any use of data mining, robots, or similar data gathering and extraction tools

No right, title, or interest in or to the Services or any content on the Services is transferred to you, and all rights not expressly granted are reserved by Technoful. Any use of the Services not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.

Your privacy is very important to us. Please review our Privacy Policy, which also governs your use of our Services, to understand our practices. By using our Services, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

We reserve the right to terminate or suspend your account and access to our Services, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

WITHOUT LIMITING THE FOREGOING, NEITHER TECHNOFUL NOR ANYONE ASSOCIATED WITH TECHNOFUL REPRESENTS OR WARRANTS THAT THE SERVICES, THEIR CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

To the fullest extent permitted by applicable law, Technoful and its affiliates will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of or inability to use the Services. This includes but is not limited to any unauthorized access to or use of our servers and/or any personal information stored therein, any interruption or cessation of transmission to or from our Services, any bugs, viruses, or other harmful code that may be transmitted to or through our Services by any third party, and any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through our Services.

Technoful's total liability to you for all claims arising out of or relating to these Terms or your use of the Services shall be limited to the amount you paid, if any, for accessing the Services during the twelve months immediately preceding the date of the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

These Terms shall be governed and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. You agree that any legal action or proceeding between Technoful and you for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Istanbul, Turkey.

Any dispute arising out of or related to these Terms or our Services will be resolved through binding arbitration conducted in Istanbul, Turkey. The arbitration will be administered by a recognized arbitration institution in accordance with its rules. The arbitrator's decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

We may update the content on our Services from time to time, but its content is not necessarily complete or up-to-date. Any of the material on the Services may be out of date at any given time, and we are under no obligation to update such material.

No waiver by Technoful of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
